DISTANCE SALES AGREEMENT

ARTICLE 1 - PARTIES

Hereinafter referred to as the "BUYER."

ARTICLE 2 - SUBJECT

This agreement determines the rights and obligations of the parties regarding the sale and delivery of the product ordered by the BUYER through the website www.fylajewellery.com (“Website”) in accordance with the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

ARTICLE 3 - PRODUCT DETAILS, SALES PRICE, AND DELIVERY INFORMATION

The name, quantity, total price including VAT, and delivery details of the purchased product(s) are as follows:

 ARTICLE 4 - GENERAL TERMS

4.1. The BUYER acknowledges that they have read and understood the basic characteristics of the product, total price including all taxes, payment method, and delivery details as well as the SELLER’s trade name, address, and contact information on the Website and that they have been informed about their right of withdrawal before confirming the order electronically.

4.2. The product will be delivered to the BUYER or the person/entity specified by the BUYER within a maximum of 30 (Thirty) days from the order date unless it is a custom-made product.

4.3. If the BUYER orders a product to be delivered to another person or entity, the SELLER is not responsible if the recipient refuses to accept the delivery.

4.4. The SELLER is not liable for delivery failures caused by issues encountered by the shipping company.

4.5. The SELLER is responsible for delivering the product intact, complete, and in compliance with the specifications stated in the order.

4.6. In case of technical or typographical errors related to the price, description, or features of a product listed on the Website, the SELLER reserves the right to cancel the order and refund the payment.

4.7. Since the products sold on www.fylajewellery.com are handmade, weight, length, and width measurements may vary by ±10% due to production differences.

4.8. If it becomes impossible to supply the ordered product, the SELLER will inform the BUYER within 3 days and refund the full amount within 14 days.

4.9. If the ordered product cannot be supplied after a campaign period, the BUYER may accept an alternative product of equal price and quality.

4.10. If, after delivery, the BUYER’s credit card or bank card is used fraudulently by unauthorized parties, and the bank does not transfer the payment to the SELLER, the BUYER must return the product within 3 days.

4.11. In case of force majeure (e.g., adverse weather conditions, transportation disruptions), if the SELLER is unable to fulfill the order on time, the BUYER has the right to cancel the order.

ARTICLE 5 - RIGHT OF WITHDRAWAL

5.1. The BUYER has the right to withdraw from the contract within 14 days without providing any reason.

5.2. However, custom-made rings and engraved wedding bands are non-refundable. Additionally, for special ring orders placed through fylajewellery.com, a 5% deduction applies to cancellations and returns.

5.3. To exercise the right of withdrawal, the BUYER must notify the SELLER within the 14-day period via phone or e-mail.

5.4. Returned products must be sent back in their original box, packaging, with certificates, and all accessories intact. Any missing or damaged items will be deducted from the refund amount.

5.5. The carrier designated under the right of withdrawal will be specified to the buyer by the seller.

ARTICLE 6 - CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for the following products:

●       Custom-made or personalized products (e.g., resized rings, engraved wedding bands)

●       Services initiated with the consumer's approval

●       The return of products whose prices fluctuate due to financial market changes will be processed based on the sales price at the time of order.

ARTICLE 7 - DISPUTE RESOLUTION

The BUYER may submit complaints related to their order or product to the SELLER’s contact details provided in this contract.

Any disputes arising from this agreement shall be governed by the laws of the Republic of Turkey, and the Istanbul Courts and Enforcement Offices shall have jurisdiction.
